Dog Attacks my family

We have been busy yesterday, and today in prep for tomorrow’s depositions. Myself wife, 2 children, and myself all have a lawsuit deposition tomorrow for the Dec 2023 pit pull attack that killed one of our dogs and bit my daughter.

I’ve been reading disclosures, opposing parties depositions, and medical evals for the bite and emotional trauma. Just being refreshed on everything and prepared for tomorrow. The lawyer says in total it will probably be about a 6hr day by the time we are all done.

Wow, I just read all of this.

I am really sorry.
I know people say dogs only act out when humans treat them poorly, but I will never trust a pit bull around a small animal or a child. I have seen it happen too many times. While I know there are good pit bulls out there, something in their genetics seems to make them turn out of nowhere.

It's their natural instinct, and if there's two or more they become a pack which can turn dangerous quick. You can't breed that out of such dogs.

I myself would never want to own one and I tend to avoid those people who have them (was attacked by a dog as a child).

Yeah man it was just one of those unfortunate situations that had a really bad outcome. It’s extremely hard as a father to accept that you failed to protect your children.
 
Dispositions went well today. Our lawyer said if we don’t negotiate a settlement that we can accept then he has no problem taking this case to trial in front of a jury. That sounds like good news to me however I’ve never done this before so I’m relying on our lawyer for appropriate guidance.

I’m really sorry you and your family had to go through something like this. Reading this honestly made my blood boil. Your daughter sounds like a brave kid, and I can’t imagine how hard this has been for your family. I hope you guys can heal from this and that the owner is held accountable.

Thank you Sir! I appreciate it. It has been hard to stay composed from the moment it happened even up till now.

I have sued and won against the dog owner but she/her family that were tenants had no renters insurance and were all recovering addicts just out of prison and remained junkies for the time they lived next to us. I knew I wasn’t gonna get a dime from them however now with that judgement she cannot buy or sell any form of property legally until the payment has been made. I don’t think it’s gonna make a big difference bc the only place she will be buying or selling anything next will be right back in prison.

So currently we are awaiting settlement talks from the home owner. I am holding them responsible for negligence. They knew that dog and the people there were problems. There are more than 6 months prior to the incident police reports, and emails and txt messages between the home owner and the neighbor on the other side. That neighbor was also attacked in her garage 3 wks prior to the attack on my family. So I am suing the home owner who does have home owners insurance to make a payout.

I’m not in it for the money. I’m doing it to hold people responsible as it should be. I will only see the money for the vet bills. The rest of the settlement money goes to my son and daughter and they can’t use it until 18.
